Ensuring previous employees benefit from the teacher aide pay equity settlement.

The Teacher Aide Pay Equity Settlement covers all teacher aides, including those who have left employment since 12 February 2020. A teacher aide may have been employed in a new position at your school, started working at another school or left the workforce entirely.  

Actions required by schools: 

  • If you employed a teacher aide who left between 12 February and 30 June 2020, who has not resumed working at your school or another school, they will need to sign a TAPEC previous employee agreement to receive the benefits of the settlement. 
  • Teacher aides who left employment after 30 June 2020 and who are not members of NZEI Te Riu Roa or have not signed the pay equity Individual Employment Agreement, will also need to sign a TAPEC previous employee agreement. 

To help you understand what actions, if any, you need to take, the Ministry of Education has prepared a flowchart, which is available on their website: 

You can download a copy of the TAPEC previous employee agreement on the Ministry of Education website – This agreement must be signed by you and the teacher aide. Once signed, you need to notify Education Payroll using a Novo22nt form.

By signing the previous employee agreement, the teacher aide is waiving their ability to raise a pay equity claim in the future. Previous employees will have up to six years to raise a claim or seek back-payment. 

Your school has already received funding for all teacher aides including those who may no longer be in employment. This was received as part of your 2020 funding instalments.
